1. General information
The following General Terms and Conditions apply to all contracts, deliveries and other services concluded via the online store floristikcenter.ch. The online store is operated by the company Dekoflor Baumann (hereinafter referred to as floristikcenter.ch). All deviating provisions of the contractual partners are hereby expressly rejected by floristikcenter.ch. Deviations from the General Terms and Conditions of Business shall only be valid if floristikcenter.ch agrees to them in writing.
2. Conclusion of contract
The offer from floristikcenter.ch is non-binding. Deviations and technical changes to the illustrations (colors, dimensions, quantities, etc.) or descriptions displayed in the store are possible. By clicking on the "Order" button at the end of the ordering process, a binding order is placed for the goods in the shopping cart. floristikcenter.ch immediately informs you of the receipt of the order by means of an automated e-mail. This automated e-mail confirms that the purchase contract has been concluded. Confirmed orders can be canceled by floristikcenter.ch at any time due to external circumstances beyond the control of floristikcenter.ch without incurring any costs. If an order is canceled by the customer before delivery of the goods, floristikcenter.ch is entitled to charge the buyer for all costs incurred as a result of the cancellation. In the case of goods specially manufactured or specially procured for a customer, cancellation of the contract and return of already delivered, defect-free goods is generally excluded.
3. Prices
All prices are net prices including VAT, excluding postage and packaging. floristikcenter.ch reserves the right to change prices at any time. The price displayed in the online store at the time of the order is decisive for the conclusion of the purchase contract. Price errors are expressly reserved.
4. Payment
Every order is paid by invoice, Twint, Postfinance Pay or credit card. Exceptions are a direct agreement with the owner of floristikcenter.ch. As an external payment service provider, Powerpay offers the payment method "invoice". With the single invoice, you can simply pay for your online purchase by invoice. If you decide not to pay within the specified time frame, you will receive a monthly invoice with an order overview in the following month. When the purchase contract is concluded, Powerpay takes over the invoice claim and processes the corresponding payment modalities. When purchasing on account, you accept Powerpay's general terms and conditions in addition to our general terms and conditions.
5. Dispatch
The dispatch takes place in standard Swiss Post parcels. The shipping costs can be found under shipping costs. Larger parcels can be sent by a forwarding agent.
6. Delivery
floristikcenter.ch delivers exclusively to Switzerland and Liechtenstein. The published delivery times are to be understood as guidelines and are not binding. If a delivery deadline cannot be met, the customer may withdraw from the order placed after a grace period of at least 14 days to be notified in writing. If, in exceptional cases, goods are not in stock, floristikcenter.ch of the delay in delivery and agrees the further procedure individually. The transportation risk is transferred to the buyer as soon as the order has been handed over to the post office. Damage to the delivered goods must be reported to Swiss Post as soon as possible, but at the latest within 8 days of delivery. Further information from Swiss Post can be found here.
7. Partial deliveries
We reserve the right to make partial deliveries if this appears to be advantageous for speedy processing. This does not result in additional shipping costs.
8. Defects in the delivered goods
Defects in the delivered goods must be reported to floristikcenter.ch as soon as they are discovered. If the defect is due to improper use, storage or handling, the liability for defects shall lapse. Insignificant deviations from warranted characteristics of the goods do not trigger any warranty rights. The buyer is only entitled to the right to repair or replacement. Cancellation or reduction are excluded. The decision to repair or replace an item lies with floristikcenter.ch. Wearing parts, batteries and rechargeable batteries are excluded from the liability for defects. Further processing with regard to returns and any crediting of costs will be handled individually.
9. Right of withdrawal
In principle, there is no general right of return. However, we offer you a 30-day right of exchange. Items can be returned within 30 days of receipt of delivery and the money will be refunded to you in the form of a goods voucher. However, the return must be agreed with us in advance and the return must be approved in writing by floristikcenter.ch. The goods must be complete, undamaged, unused and in their original packaging. Used, assembled or not originally packed goods are excluded from the right of exchange.
10. Place of jurisdiction
Birmensdorf is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
